Monday, March 9, 2009 at 10:28AM 'Terminator' Litigation: The Lawsuit Begins
Well, a Warner Bros. legal entanglement over Watchmen certainly raised the profile of that film,
so maybe lightning can strike twice with Terminator Salvation. Producer Moritz Borman has sued fellow producers Derek
Anderson and Victor Kubicek of Halcyon, citing fraud and breach of contract. Variety reports that Borman claims he
hasn't been paid his producer's fees.

But this isn't just a clerical error. Borman is painting his fellow producers with an unflattering brush, saying the pair has
a "shady" background, has been sued for "swindling" investors before, accuses them of "egregious fraud," and that Anderson
and Kubicek "hijacked" the production after principal photography wrapped last summer.
That's when Borman's claims take flight. He asserts that in addition to not being paid by the producers himself after the film
wrapped, Terminator Salvation defaulted on several loans from financiers, and was in significant debt to creditors.
The suit seeks more than $160 million in damages, a lot of which is back end stuff. Unlike the Watchmen lawsuit,
there's nothing here that would keep the film out of theaters in a couple months, in case you were worried. But it sure will
make that premiere party a little frosty at the producers' table.

Like "Heavy Metal" we will never get to see this on VHS. For at least 15 yrs.
He was buffaloed on this one. The agreement was made without his direct involvement. His company was set up.
