Wednesday, October 26, 2011 at 10:27AM Sylvester Stallone Sued for Plagiarism in 'Expendables' Screenplay

It was reported last night by The Hollywood Reporter that Sylvester Stallone is being sued by screenwriter Marcus Webb, who claims that Stallone "borrowed" parts of a screenplay of Webb's entitled The Cordoba Caper for the 2010 action blockbuster The Expendables. The plagiarized elements are said to include the "villain, plot about mercenaries, and opening sequence."
I wasn't a big fan of The Expendables, likely because I was never a big fan of the 80's macho action flicks it was imitating. It's derivative style does bring an interesting angle to the accusations. Considering The Expendables villain was pretty much just a knockoff of the average Schwarzenegger/Van Damme/Segal villain, I'm a bit curious as to how one would go about proving he was plagiarized. Of course, with Webb's script floating around in Hollywood from around 2006-2009, the possibility is certainly there.
Despite my dislike for his most recent film, I do hope that the claims made against Stallone are false. He's shown himself to be a tremendous creative force since his comeback with 2006's Rocky Balboa, and I'd really like to think he was above this kind of thing. Don't be looking for a definitive answer, though, as these issues tend to be resolved in undisclosed out of court settlements (see the similar controversy with 2005's The Island).
But there's one thing I really have to say: Mr. Stallone, speaking in the chance that any of these accusations are actually true, couldn't you have plagiarized from something a bit more original?

First, The Expendables is not an impressive move...typical of Mr. Stallone's devotion for meaningless violence. If here really stole the opening part from Marcus Webb, then I'm left with nothing to say.
